Demande de mesures d’urgence des détenus rejetée par la justice

Dans son ordonnance, consultée samedi par l’AFP, le juge des référés a rejeté la requête. Il a considéré que les demandes effectuées par les détenus de la maison d’arrêt de Bois-d’Arcy dans les Yvelines ne répondaient pas à une situation d’urgence.

S’il a pointé «certains incidents ponctuels«, il a toutefois rejeté l’idée d’un «dysfonctionnement au sein de l’établissement«. Dans leur requête, les détenus pointaient une réponse inadéquate, voire inexistante aux violences entre codétenus, mais aussi à celles imputées à des surveillants.

Les plaignants accusaient certains agents de «manquements graves à la déontologie«: réveils nocturnes, refus arbitraires de douche, jets de courriers, insultes et menaces.

The tribunal administratif de Versailles rendered its decision this Friday. The detainees had denounced «serious breaches of ethics» regarding their detention conditions.

In his order, consulted by the AFP on Saturday, the presiding judge dismissed the request. He considered that the demands made by the detainees at the Bois-d’Arcy detention center in the Yvelines did not meet the criteria for an emergency situation.

While he acknowledged «certain isolated incidents,» he nevertheless rejected the idea of a «dysfunction within the facility.» In their petition, the detainees pointed out an inadequate or non-existent response to violence between inmates, as well as violence attributed to prison guards.

The plaintiffs accused certain staff members of «serious breaches of ethics»: nighttime wake-ups, arbitrary shower refusals, mail throwing, insults, and threats. They requested emergency measures in response to what they described as a «climate of violence.» The Association for the Defense of Detainees’ Rights (A3D) and the International Observatory of Prisons (OIP) were also applicants alongside the detainees.

In his order, the presiding judge instructed the Minister of Justice, Gérald Darmanin, to «ensure that night patrols do not harm the well-being and health of detainees.» He also asked him to ensure «that detainees have access to showers with an acceptable water distribution temperature» and to «guarantee that the mail they receive or send is processed within a reasonable timeframe.»

«These detainees know the risks of filing this petition,» emphasized their lawyer, Me Juliette Chapelle, during the hearing, stating that her clients could face retaliation from prison staff.

The detainees’ lawyer also recalled the assault in November 2023 of a detainee by a guard, which resulted in 31 days of total incapacity for work. A criminal proceeding is underway, and the guard is set to be tried in Versailles soon.

«The message being sent is that one can be assaulted in detention, even to the point of suffering in their cell with long response times without it being a problem,» lamented Me Chapelle, contacted by the AFP. Please provide an alternative version.
