Un tribunal de Hong Kong a prononcé, lundi 9 février, une peine totale de 20 ans de prison à l’encontre de l’ex-magnat des médias prodémocratie Jimmy Lai. Il était poursuivi pour collusion avec l’étranger et publication séditieuse. L’homme d’affaires, reconnu coupable le 15 décembre de trois chefs d’accusation, risquait la prison à vie. Dans leur jugement de 856 pages rendu le 15 décembre, les juges avaient écrit que l’ex-magnat de 78 ans avait «nourri sa rancoeur et sa haine envers [la Chine] pendant une grande partie de sa vie d’adulte» et qu’il avait cherché à «renverser le Parti communiste chinois». La cour a cependant dit prendre en compte le fait que «la conjugaison du grand âge de Lai, de son état de santé et de son maintien à l’isolement aurait pour effet de rendre un emprisonnement à vie plus lourd que pour d’autres détenus».
La peine, prononcée malgré les pressions du Royaume-Uni, des Etats-Unis et des défenseurs des droits, est la plus lourde jamais prononcée au titre de la loi sur la sécurité nationale imposée en 2020 par la Chine après les manifestations prodémocratie qui avaient secoué le territoire un an plus tôt. «Condamner mon père à cette peine de prison draconienne est dévastateur pour notre famille et met sa vie en danger. Cela marque la destruction totale du système judiciaire de Hong Kong et la fin de la justice», a réagi son fils Sebastien Lai, dans un communiqué.
Jimmy Lai avait plaidé non-coupable. Il a 28 jours pour faire appel, selon son avocat Robert Pang, qui n’a pas précisé s’il ferait usage de ce droit.
Human Rights Watch s’est ému de la condamnation du fondateur du journal prodémocratie Apple Daily à 20 ans de prison, déclarant que cela équivaut à un arrêt de mort. De son côté, Amnesty International a déploré une nouvelle date sombre dans la transformation de Hong Kong d’une ville gouvernée par l’Etat de droit en une ville gouvernée par la peur.
